MYWAY Terms and Conditions

This Terms of Service Agreement (the “Agreement”) constitutes a legally binding contract between you (“you,” “your”) and MYWAY, a brand of Mata Hall Operations S.A. de C.V. (“MYWAY,” “we,” “our,” or “us”) regarding your use of the MYWAY application, website, and technology platform (collectively, the “MYWAY Platform”) and our Services (as defined below). Please read this Agreement carefully before using the MYWAY Platform or our Services.

I. MYWAY Platform and Services

The MYWAY Platform provides access to corporate mobility solutions, enabling users to contract safe and efficient transportation services through our dedicated fleet and professional drivers.

To access MYWAY services, you must create a user profile and accept these Terms and Conditions, as well as our Privacy Policy.

II. Modifications to the Agreement

We reserve the right to modify these terms at any time. Any modifications will become effective once published on the MYWAY Platform. Your continued use of our services after modifications are posted will constitute your acceptance of the updated terms.

III. Eligibility and Responsibility

You must be at least 18 years old to create a user account on MYWAY. By registering, you confirm that you meet this requirement and have the legal capacity to accept this Agreement. If you use MYWAY on behalf of another person or entity, you declare that you are duly authorized and will be responsible for any breach of this Agreement.

IV. Security and Recordings

For security purposes, all trips in MYWAY vehicles may be recorded on video. By requesting or using our services, you consent to these recordings and are responsible for informing any accompanying passengers of this condition.

V. Fees and Payments

Users acknowledge that using MYWAY services incurs charges, including:

  • Trip fares, determined based on the distance and duration of the journey.
  • Waiting charges and additional service fees.
  • Cancellation fees.
  • Damage fees for vehicle incidents.

MYWAY reserves the right to modify fees and charges at any time, providing prior notice to users.

VI. MYWAY Communications

By registering, you agree to receive communications via email, text messages, and push notifications related to our services. You may opt out of promotional communications at any time through your account settings.

VII. Proper Use and User Conduct

Users agree to:

  • Not use the MYWAY Platform for illegal or harmful activities.
  • Not harass, threaten, or discriminate against drivers or other users.
  • Comply with all applicable safety regulations and laws.

Failure to adhere to these rules may result in suspension or termination of the user’s account.

VIII. Cancellation Policy

If a user cancels a trip after a driver has been assigned, a cancellation fee may apply. MYWAY may modify this policy as necessary.

IX. Intellectual Property

All intellectual property rights related to the MYWAY Platform belong exclusively to Mata Hall Operations S.A. de C.V. Users may not copy, modify, or distribute any content from the Platform without prior authorization.

X. Limitation of Liability

MYWAY does not guarantee uninterrupted or error-free use of the Platform. In no event shall MYWAY be liable for indirect, incidental, or consequential damages resulting from the use of our services.

XI. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through binding arbitration, in accordance with applicable laws in Mexico City. Both parties expressly waive the right to file class-action lawsuits or litigate in courts.

XII. Termination of Service

MYWAY reserves the right to suspend or terminate access to the Platform and its services in the event of a violation of these terms. Users may also close their accounts at any time.
